Terms of Use

These Terms of Use ("Terms") govern your use of the Softball IQ mobile application and the softballiqpro.com website (collectively, the "Service"), operated by Incalculable LLC ("we," "our," or "us"). By using the Service, you agree to these Terms.

1. Eligibility

The Service is designed for users aged 8 and older. Users under 13 should have parental or guardian consent before using the Service. By using the Service, you represent that you meet this requirement.

2. Account & Access

• You may use the app anonymously or sign in with Apple.
• You are responsible for maintaining the security of your account.
• You may not share, sell, or transfer your account to another person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions & Payments

• Softball IQ offers free and paid tiers. Free users receive 3 games per day.
• Paid subscriptions (Pro, AI Coach, Organization plans) are billed through Apple's App Store.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions in your Apple ID settings.
• Refunds are handled by Apple per their refund policy.
• Prices may change with notice. Existing subscribers will be notified before any price increase takes effect.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the app
• Interfere with or disrupt the Service or servers
• Use automated tools (bots, scrapers) to access the Service
• Submit false or misleading information
• Harass, abuse, or harm other users

5. AI Coach

The AI Coach feature provides educational softball information generated by artificial intelligence. Responses are for informational and entertainment purposes only. We do not guarantee the accuracy of AI-generated content. The AI Coach should not be used as a substitute for professional coaching or medical advice.

6. Organization & Team Features

• Organization admins are responsible for managing their teams, coaches, and invite codes.
• Coaches and admins should not share invite codes publicly.
• We are not responsible for how organizations use the team management features.

7. Intellectual Property

All content in the Service — including questions, design, graphics, and software — is owned by Incalculable LLC and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. User Content

When you submit support tickets or other content through the Service, you grant us a non-exclusive, royalty-free license to use that content for the purpose of providing and improving the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Incalculable LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Incalculable LLC from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.
